MNest is a curated discovery platform for machinima and motion‑based films. By accessing MNest or submitting a film, you agree to these Terms of Service. MNest is built on transparency, creator ownership, and minimal data collection. MNest does not track users, sell data, or use advertising cookies.
1. Using MNest
MNest provides access to curated films that are publicly available on YouTube. MNest does not host video files; all approved films remain on YouTube and are embedded on MNest for discovery and curation.
MNest may also display thumbnails of publicly available YouTube films for discovery purposes. These thumbnails do not display or embed the film itself until the creator submits it.
You may browse MNest without creating an account. MNest does not offer viewer accounts, creator dashboards, or personalized features. MNest may send newsletters or platform updates to users who voluntarily subscribe.
2. Supported Mediums
Machinima Machinima is the art of directing films inside real‑time 3D worlds — engines, games, and virtual environments where creators puppeteer characters, stage performances, and operate virtual cameras to craft cinematic stories.
Motion Motion refers to films created through AI‑driven generation, intelligent systems, or machine‑assisted cinematography. This includes frame‑based generation, model‑driven animation, AI‑generated actors or environments, hybrid workflows, and emerging forms of machine‑born cinema. Creators retain full ownership of their Motion films and must ensure they have rights to all AI‑generated or AI‑assisted content used.
3. Film Submissions
Creators may submit films for review through the MNest submission form. By submitting a film, you confirm that:

you own or have rights to all content in the film

the information you provide is accurate
-
the film complies with the Guidelines and Agreement sections of the MNest Creator Guide
-
MNest may approve, decline, or remove your film at its discretion
-
MNest may display your film publicly on the MNest website if approved
Submission does not guarantee acceptance.
4. Discovery‑Only Additions
MNest may display a thumbnail of a publicly available YouTube film for discovery purposes without a formal submission. These thumbnails:

do not embed or display the film itself
-
do not include the film’s YouTube URL
-
do not constitute hosting or redistribution
-
appear with a Discovery Pending notice
-
link to a modal explaining that the film has not been submitted
The film is not displayed on MNest until the creator submits it.
MNest may remove discovery‑added thumbnails at the creator’s request or at MNest’s discretion.
Discovery suggestions do not guarantee inclusion.
5. Suggest a Film
Users may suggest publicly available YouTube films for MNest to review. By using the “Suggest a Film” feature, you agree that:

MNest may review or decline your suggestion

MNest may add a thumbnail of the suggested film to Discovery‑Only Additions if appropriate

MNest does not embed or display the film itself unless the creator submits it

MNest may remove the thumbnail at any time

MNest may contact the creator to encourage submission
Suggestions are not submissions and do not guarantee inclusion.
6. Creator Ownership
Creators retain full ownership of their films. MNest does not claim rights to your content.
By submitting a film or allowing MNest to display it, you grant MNest permission to:

embed the YouTube video
-
display the film’s thumbnail, title, and description
-
show your creator name
-
include the film in curated collections on the MNest website
You may request removal at any time.
7. Promotional Use (Optional)
MNest may feature your film in promotional materials — including newsletters, curated highlight reels, MNest’s YouTube channel, or MNest’s social media platforms — only if you explicitly opt in during submission.
If MNest’s YouTube channel becomes monetized, you understand that promotional content featuring your film may appear on a monetized channel. MNest does not claim ownership of your film and does not monetize your film directly.
You may withdraw promotional permission at any time by submitting a brief withdrawal request through MNest’s Promotional Permission Form or by contacting contact@mnest.tv.
Withdrawal applies only to future promotional content. MNest is not required to remove or modify promotional materials that were created or distributed before your withdrawal request.
8. Curation and Removal
MNest may:

MNest’s curation decisions are final.
9. Copyright and DMCA
MNest complies with the Digital Millennium Copyright Act (DMCA). If you believe a film or thumbnail infringes your rights, you may submit a takedown request as described in MNest’s DMCA Policy.
MNest may remove films or thumbnails in response to valid notices.
10. Privacy
MNest collects only the information you voluntarily provide, such as film submissions, film suggestions, and email subscriptions. MNest does not track users or sell data.

11. Third‑Party Services
MNest relies on YouTube for video hosting and availability. MNest is not responsible for YouTube outages, removals, age restrictions, embedding limitations, or changes to YouTube’s platform.
12. AI‑Generated Content Responsibility
Creators are solely responsible for ensuring that any AI‑generated or AI‑assisted content complies with applicable laws, model licenses, rights of publicity, and intellectual property requirements.
MNest does not verify AI model usage or licensing.
13. Prohibited Conduct
You agree not to misuse MNest, including:

impersonating creators

bypassing or attempting to bypass verification

submitting unauthorized content

scraping MNest or using automated systems to access or interact with the platform

14. Disclaimers
MNest is provided “as is” without warranties of any kind. MNest is not responsible for:

15. Limitation of Liability

MNest may suspend or restrict access to the platform at any time for violations of these Terms or for platform safety.

20. Governing Law

If you believe a film or thumbnail displayed on MNest infringes your copyright, you may submit a DMCA Takedown Notice. Your notice must include:

6. Counter‑Notifications
If your film or thumbnail was removed due to a DMCA notice and you believe the removal was in error, you may submit a counter‑notification. Your counter‑notification must include:

8. Repeat Infringers
MNest implements a repeat infringer policy in accordance with the DMCA. MNest may:

decline future discovery additions from creators with repeated violations
9. Misuse of the DMCA Process
